The I-751 petition to remove conditional status remains pending until the USCIS approves or denies the petition. The petitioner remains in valid status during case processing.
Allan
Notice of receipt of petition submission is valid for one year, but the USCIS can take more than one year to adjudicate the petition. Employers do not have proof of lawful status and a delayed petition can hamper international travel or prevent renewal of a driver’s license.
Within 30 days prior to expiration of the Notice of Receipt, the petitioner may apply at a local USCIS District Office for an I-551 stamp.
That stamp verifies that the petitioner remains in lawful status in the U.S. until the USCIS finally makes its decision.
If you are nearing expiration of your petition to remove conditional status, you should schedule an Infopass appointment at a local USCIS office. Appear at the local office for an emergency appointment if no dates are available anytime soon and you have good cause such as a pending job offer, an expiring driver’s license, or upcoming international travel.
Bring with you:
- Valid, unexpired passport;
- InfoPass appointment notice (if applicable);
- Form I-751 receipt notice;
- Expired CPR card; and
- Proof of residence within the jurisdiction of the USCIS office.
People contact our offices routinely to assist with petitions for removal of conditional status. Our legal fees are reasonable and assistance can help reduce problems in trying to obtain the I-751 removal of conditional status. The USCIS will refer the case to immigration court for deportation if the petition is not approved.
Removal proceedings are stressful and quite expensive by comparison, so it’s important to get things right the first time.
