The Fiancé Visa

The fiancé visa K1 process starts with filings in the U.S., and ends with an interview at the U.S. consulate abroad where your foreign fiancé resides. A K1 fiancé petition cannot be started outside the U.S., and it cannot be completed inside the U.S.

The fiancé visa petitioner must be a U.S. citizen. Each of you must be free to marry, with all prior marriages terminated. You must have met in person within the previous two years. A hardship waiver is available for those who have serious physical limitations when traveling.

Finally, the U.S. citizen must satisfy a minimum income requirement to ensure adequate support once the fiancé arrives in the U.S.

You have 90 days to marry once your fiancé arrives in the U.S.
