Green Card based on Marriage

The green card adjustment of status process starts with filings in the U.S. and ends with an interview at a local USCIS office near where you and your spouse reside.

Green card processing does not occur outside the U.S. Consider a CR marriage visa for those foreign spouses who are abroad.

The petitioning spouse must be either a U.S. citizen or lawful permanent resident (“green card” holder). The foreign spouse must have entered the U.S. on a valid visa, such as that for a visitor, student, or employee. Entry on certain visas or unlawful entries will disqualify a foreigner from adjusting status stateside.

The couple must be free to marry, and the marriage must be lawful at the place the marriage occurs; it must be pursuant to U.S. immigration rules.

Furthermore, the U.S. citizen must satisfy a minimum income requirement to ensure adequate support once the spouse arrives in the U.S.

Finally, unmarried children under the age of 18 at the time of marriage may immigrate as well, whether or not inside the U.S. Those children nearing the age of 21 during case processing may age out.
