The Marriage Visa
The CR Marriage Visa process starts with filings in the U.S. and ends with an interview at the US consulate abroad where your foreign spouse resides. A CR marriage petition cannot be started outside the US, and it cannot be completed inside the US. For those foreigners who are already in the US, consider Adjustment of Status. For those not yet married, consider a K1 Fiance visa.
The marriage visa petitioner must be either a US citizen or lawful permanent resident (“green card” holder). The couple must be free to marry, and the marriage must be lawful at the place the marriage occurs. It must be pursuant to US immigration rules. A proxy marriage must be consummated. Furthermore, the U.S. citizen must satisfy a minimum income requirement to ensure adequate support once the spouse arrives in the U.S. Finally, unmarried children under the age of 18 at the time of marriage may immigrate as well. Those children nearing the age of 21 during case processing may age out.
